By downloading, installing, or using the IQ.Fishing mobile application or any IQ.Fishing web service (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
IQ.Fishing is a fishing companion application that provides catch logging, AI-assisted species identification, tide and weather forecasts, solunar data, offline maps, fishing spot management, group catch sharing, and tournament features. Features vary by subscription tier.
You must be at least 13 years old to use IQ.Fishing. If you are under 18, your parent or guardian must also agree to these Terms. By using the Service, you represent that you meet these requirements.
You may create an account using Google or Apple sign-in. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. You agree to provide accurate information and to notify us promptly of any unauthorized use of your account at support@IQ.Fishing.fishing.
IQ.Fishing offers three tiers: Free, Angler, and Pro Angler. Paid tiers are billed on a recurring basis through the Apple App Store or Google Play Store depending on your platform.
All subscription payments are processed by Apple or Google. Pricing, billing frequency, and refund policies for subscriptions are governed by your platform's terms and policies. IQ.Fishing does not process subscription refunds directly.
You may cancel your subscription at any time through your platform's account settings. Cancellation takes effect at the end of your current billing period; you retain access to paid features through that date.
Tournament entry fees are separate from subscriptions and are processed by Stripe. IQ.Fishing charges a $2.00 platform fee per registered angler in addition to any entry fee set by the tournament organizer. Tournament entry fees are non-refundable unless the tournament is cancelled by the organizer, in which case refunds are issued to the original payment method within 10 business days.
You retain ownership of the catch records, photos, and other content you upload ("User Content"). By uploading User Content, you grant IQ.Fishing a non-exclusive, royalty-free license to store, display, and transmit your User Content within the Service — for example, to share catches with members of your groups.
You agree not to upload, share, or submit content that:
IQ.Fishing uses automated screening and user reports to identify prohibited content. We reserve the right to remove any User Content that violates these Terms at any time without notice. Users may report objectionable content shared within groups. Repeated violations may result in account suspension or permanent termination.
You agree not to: attempt to circumvent subscription limits or access features not included in your tier; reverse engineer or extract source code from the app; use automated scripts or bots to interact with the Service; interfere with the Service's servers or infrastructure; or impersonate another user or entity.
IQ.Fishing uses artificial intelligence (Anthropic Claude) to assist with species identification from photos. AI-generated identifications are estimates and may be incorrect. They are provided for informational and logging purposes only and are not intended for regulatory, legal, or scientific use. You are responsible for verifying species identification independently.
IQ.Fishing does not provide fishing regulation, licensing, or legal compliance advice. Tide, weather, and solunar data are provided for informational purposes only. You are solely responsible for knowing and complying with all applicable local, state, and federal fishing laws and regulations, including size and bag limits, license requirements, and closed seasons.
The Service integrates with third-party providers including Amazon Web Services (data storage and hosting), Firebase by Google (authentication), Anthropic (AI features), NOAA and Open-Meteo (weather and tide data), Mapbox (mapping), RevenueCat (subscription management), and Stripe (payment processing). Your use of these integrations may be subject to those providers' own terms and privacy policies.
IQ.Fishing, the IQ.Fishing logo, TrueCatch, and all related marks, features, and content are the property of IQ.Fishing and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or branding.
Our collection and use of your personal information is described in our Privacy Policy. By using the Service, you agree to the Privacy Policy.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. IQ.Fishing MAKES NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY DATA — INCLUDING TIDE, WEATHER, OR SOLUNAR INFORMATION — WILL BE ACCURATE OR COMPLETE. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
TO THE FULLEST EXTENT PERMITTED BY LAW, IQ.Fishing SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. IN NO EVENT SHALL IQ.Fishing'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO IQ.Fishing IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) $10.00.
IQ.Fishing may suspend or terminate your account at any time for violation of these Terms or for conduct we determine to be harmful to other users or to the Service. Upon termination, your right to use the Service ceases immediately. Sections 6.1, 11, 13, 14, and 16 survive termination.
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved in the state or federal courts located in North Carolina, and you consent to personal jurisdiction in those courts.
We may update these Terms from time to time. We will notify you of material changes by email or through an in-app notice at least 30 days before the changes take effect. Your continued use of the Service after that date constitutes acceptance of the updated Terms.
If you downloaded IQ.Fishing from the Apple App Store, your use of the app is also subject to the Apple Standard End User License Agreement (EULA). In the event of any conflict between these Terms and the Apple EULA, the Apple EULA governs solely with respect to Apple's obligations. Apple is not a party to these Terms and is not responsible for the app or its content.
